Mark Mendel, the attorney who used to successfully represent Antigua in the case that the country brought complaint against the U.S. to the WTO in Geneva , Switzerland , proved that the points which the U.S. insists on towards Internet gaming is contradictory for several aspects. Mendel also pointed out that, though the U.S. insists that it is illegal to use offshore outlets by American gamblers to play foreign gambling, the fact has been continuing within the boundary of USA .
To give an instance of the contradictory policy, Mendel cited one case from a partner at Mendel's El Paso that Texas-based law firm was capable to use a credit card purchasing lottery tickets over the telephone from the Massachusetts State Lottery.
"Then there's totally morals issue only," Mendel stated, "And the reasoning is becoming impenetrable. The U.S. government made a final declaration that foreign gambling is bad and evil while brick and mortar gambling is not."
